Recent federal court rulings determined that duties imposed under the International Emergency Economic Powers Act, commonly referred to as IEEPA, were unlawful. These decisions have created the opportunity for many importers of record to recover billions of dollars by claiming refunds from the U.S. Customs and Border Protection (“CBP”) now. The underlying businesses that ultimately paid the price for higher tariffs also have potential opportunities to share in these massive tariff refunds.
