The conference session examines Subchapter V of Chapter 11, the path Congress created in 2020 to give small business debtors a faster, more affordable reorganization option. Staeven joins Richard H. Nemeth, Co-Managing Partner at Nemeth & Perry, LLC, to walk through eligibility criteria for Subchapter V filings, the distinct role a Subchapter V trustee plays in a case, and the requirements for plan confirmation.

Consumer bankruptcy attorneys who represent small business clients will leave with practical guidance for moving a client through reorganization efficiently, including how to evaluate whether a case fits Subchapter V in the first place.
