Intangible property and its value have been at the core of the largest international tax and transfer pricing disputes, from the $3.4B GSK settlement to the ongoing Facebook case. While the handful of Tax cases on this topic have been widely dissected, intellectual property litigation cases use a similar set of comparability criteria and provide a valuable pool of guidance. In this presentation, we will discuss select Daubert and Federal Circuit Court decisions which are helpful in analyzing intangibles and comparability.
