Frost Law is seeking an experienced Attorney to join our Business & Commercial practice, focusing on U.S. Small Business Administration (SBA) Economic Injury Disaster Loan (EIDL) programs and related federal lending matters. The ideal candidate brings a strong background in federal loan compliance, workout and restructuring, administrative law, and small business advocacy.
This is a meaningful opportunity to help small business owners navigate complex federal lending obligations — from loan modifications and hardship accommodations to default defense and Treasury referrals — while collaborating with a seasoned team of attorneys, CPAs, and financial professionals across Frost Law's broader tax and business practice.
Key Responsibilities
- Advise and represent clients in all phases of SBA EIDL matters, including loan modifications, deferment requests, hardship accommodations, and repayment negotiations.
- Represent clients in SBA loan defaults, demand letters, and Treasury referrals, including Offer in Compromise (OIC) submissions and Due Process hearings.
- Draft and review personal guaranty agreements, collateral documents, and loan authorization packages.
- Counsel clients on SBA EIDL compliance obligations, including use-of-proceeds requirements, collateral covenants, and reporting duties.
- Handle matters involving the SBA's Office of Disaster Assistance (ODA) and coordinate with assigned loan service centers.
- Assist clients facing SBA litigation, judgment enforcement, wage garnishment, or bank account levies initiated by the Department of Treasury or the Department of Justice.
- Advise on related government-backed lending programs, including SBA 7(a) and 504 loans, USDA Business & Industry loans, and other federal disaster or emergency lending programs.
- Represent clients before the SBA's Office of Hearings and Appeals (OHA) and other administrative bodies.
- Identify and pursue available defenses, including statute of limitations issues, improper servicing claims, and procedural due process challenges.
- Monitor changes in SBA regulations, policies, standard operating procedures (SOPs), and administrative guidance, and advise clients accordingly.
- Collaborate with Frost Law's financial advisors, accountants, and bankruptcy counsel on comprehensive debt resolution strategies.
Qualifications
- Juris Doctor (J.D.) from an ABA-accredited law school and active bar admission in good standing.
- 2+ years of experience in one or more of the following: SBA lending, federal loan workout, commercial lending, creditor/debtor law, administrative law, or small business legal matters.
- Strong understanding of SBA Standard Operating Procedures (SOPs) and loan program regulations (13 C.F.R. Parts 120–123).
- Excellent written and oral advocacy skills with the ability to explain complex legal matters clearly to small business owners.
- Ability to manage a high-volume caseload with strong attention to detail and organizational skills.
- Strong negotiation skills, particularly in workout and settlement contexts.
- Ability to analyze financial statements, business tax returns, and collateral documentation.
- Prior experience with SBA EIDL, PPP forgiveness disputes, or COVID-era federal loan programs is strongly preferred.
- Familiarity with the Treasury Offset Program (TOP) and cross-servicing procedures is a plus.
- Working knowledge of Chapter 7 and Chapter 11 bankruptcy as it intersects with federal loan obligations is a plus.
- Experience with Offer in Compromise submissions to the SBA or IRS is a plus.
